The Supreme Court has issued a significant ruling that sets a national precedent, affirming the ability of states to implement measures designed to safeguard women's sports. On Thursday, the justices sided with West Virginia and Idaho in cases brought against them by transgender athletes seeking to participate in girls' sports. The legal defense for the states was provided by the Alliance Defending Freedom (ADF), while the American Civil Liberties Union (ACLU) and Cooley Legal represented the transgender athletes.
These highly anticipated decisions, stemming from cases titled West Virginia v. B.P.J. and Little v. Hecox, saw the high court affirm state statutes that mandate student-athletes compete on teams aligning with their biological sex assigned at birth, rather than their gender identity. The Supreme Court's decision was rendered with a 6-3 majority.
Justice Sotomayor submitted an opinion, concurring in part with the judgment and dissenting in part, an opinion joined by Justices Kagan and Jackson. Justice Jackson also filed a separate opinion, similarly concurring in the judgment in part and dissenting in part.
The Court's opinion affirmed that, in alignment with Title IX and the Equal Protection Clause, states possess the authority to preserve women's and girls' sports for biological females. This includes the right to establish eligibility criteria for these sports based on biological sex.
